MindfulTraveller Terms and Conditions

Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions.

Joining a trip or retreat – booking procedure

Booking a trip or joining a retreat can be done by contacting the MindfulTraveller staff via the contact form on our website. Upon receipt of your booking/contact request, details of availability & money due will be emailed to you and your booking details will be finalized. You will then be sent a formal invoice with payment details. For retreats and trips, a non-refundable 20% of payment (booking payment) must be sent immediately for your booking to be held and the remaining 80% must be paid at least 1 month before the date of the trip starting. Payments must be received within 5-10 days into the provided account for your booking to be held. Once we receive the booking payment or deposit respectively we will then send you a confirmation receipt. Your booking is not confirmed until you receive a confirmation invoice.

Refund & cancellation policy

Cancellation by you

(a)                 Cancellation instructions must be made in writing via email and will be effective on the day we receive them.

 

(b)                 Depending on when notification of cancellation is received the following charges apply:

Over 1 month:  20% of total cost (i.e the non-refundable deposit)

Less than 1 month:  for retreats & trips if we are able to find an appropriate person ( i.e the same accommodation style and any additional services or specific requirements)  to fill your spot then you will receive 80% of your fee’s back. If we are unable to do so then you will be charged 100% of total cost for the trip.

Note that we cannot give any allowance for refund for meal, accommodation, transport or any other pre paid service when not taken when these are included in the price nor once the holiday as started can we give any refunds for cancelling part of the holiday.

Alterations by you

Note that retreat programs are not able to be altered except for any additional nights stay at the provided accommodation or any additional services such as transfers or food requirements. If after we have a confirmed a booking you require a change in dates for a trip or for any additional nights accommodation/transfers/foodrequirements on retreats we will do our best to meet your revised booking however any fees from cancellation or change in accommodation or any other tour activity will be incurred by you.

Cancellation and alterations by us

Once your booking has been confirmed with us we will make every effort to provide you with the booked arrangements but reserve the right to alter or cancel the whole or part of the trip if we cannot avoid doing so. Reasons for doing so are outlined in our full terms and conditions liability section and would include among other things severe local weather conditions, natural disasters, terrorist activity, fire and similar conditions.  A trip may also be cancelled up to 1 month before due to a lack of needed numbers for the specified trip to go ahead. If any such alterations are significant then you have the right to cancel where upon we will refund all monies paid as we will do in the event of cancellation by us.

Although we will make every effort to keep the programs as outlined on our website and in your booking confirmation:

We reserve the right to change accommodation at the last minute in any event whereby the establishment as previously booked has not met our expectation of service and quality for reasons beyond our control or where the liability is not ours.
We reserve the right to change, modify & cancel individual activity items on the trips and retreats where circumstances are outside of our control (such as a service provider hired is no longer available on short notice – see liability section) or where we feel there is significant reason to do so (such as the group majority on the trip would like to do something else, or we do not feel that the standard of the activity is up to our expectations for service or quality)

If the trip or retreat does not go ahead, you will be notified and all of these fees will be returned to you immediately.

What is included in retreats and trips

The inclusions for retreats & trips are outlined on the website in the inclusions section of each retreat program. Although we will try out best to deliver all of the proposed program items, we reserve the right to change, modify & cancel individual items (see cancellation policy for detaisl).

What is not included in your retreat and trips?

Travel from home country to the retreat centre or first night accommodation on trips

Transfer from airport to accommodation (unless otherwise specified)

Meals and snacks outside of included specified meals

All non-inclusive/additional costing activities and excursions not specified as included on the website or confirmation 

Prices

All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed when paid in full. Please note that prices quoted are subject to change. Price changes may occur by reason of matters outside our control, which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact us for up to date prices.

Methods of Payment

Secure Visa and Mastercard payments via PayPal. Note that all credit card payments incur a surcharge.

Age:Mindfultraveller trips and retreats are open to everyone aged 25 years and over unless specified otherwise on our website or on your invoice.

Sharing: if you have chosen to share with someone on retreat that you do not know be aware that your partner will be chosen at the discretion of the Mindfultraveller staff. If you have specific needs or wants such as gender we will try our best to accommodate these however cannot guarantee who you will get. In the event that there is discontent between the two who are sharing we will try to resolve these issues however cannot guarantee that you will be able to move rooms.

Passports & Visas:
It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. All travelers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport.

Visa Information:
If you need information regarding visa and other travel document requirements for your trip, please contact your local embassy. We do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it.

Travel and Medical Insurance Coverage: Where applicable all trip and retreat members are required to have overseas medical and accident insurance coverage. More broad travel insurance coverage for theft, flight/accommodation/course cancellations etc are also strongly recommended as mindfutraveller are not liable in these circumstances.

Health:
You must ensure that you are aware of any health requirements for your travel and ensure that you carry all necessary vaccination documentation and medication. Please check with your local doctor or specialist vaccination clinic.

Travel Documents:
Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility.

Customer Protection
 mindfultraveller provides complete financial protection for customers on our trips, formalized according to EC directives, and guarantees your money back, and your repatriation in the event of the company’s failure.

Agency 
MindfulTraveller acts as an agent on trips and retreats where not expressly indicated that they are the service provider. We sell various travel related products on behalf of numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse for travel services is against the specific provider and not us. If for any reason (excluding fault by us) any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.

Monies Not Held On Trust
 All monies paid by you to us will be the property of MindfulTraveller and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided. You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.

Governing Law 
If any dispute arises in relation to the agreement between you and us, the laws of Austria will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Austria, and waive any right that you may have to object to an action being brought in those courts.

Liability 
MindfulTraveller will not be liable in any way to the retreat or trip member in the event of any service, contracted to be supplied by MindfulTraveller, becoming impossible to supply by reason of industrial dispute or other cause outside the control of mindfultraveller. Without limitation, mindfultraveller and its parent, subsidiaries, affiliates, employees, officers, directors, or agents are not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal, terrorist or threatened terrorist activities of any kind, overbooking or downgrading or accommodations, structural or other defective conditions in lodging facilities (or in any heating, plumbing, electrical or structural problem therein), dangers associated with animals, sanitation problems, food poisoning, epidemics or the threat thereof, disease, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, or for any other cause beyond the direct control of MindfulTraveller. The trip and retreat member assumes all such risk as well as any risks with regard to independently engaged activities. MindfulTraveller reserves the right to change or cancel the program or any aspect of the program at any time. MindfulTraveller reserves the right to decline acceptance or retain any member on the program if that person’s presence is felt by Mindfultraveller to be detrimental to the enjoyment of the program by others, is dangerous to the members or others, or for failure to abide by MindfulTraveller regulations. Members who have been removed from their program waive the right to a refund of any part of the fee. TravelEdventures may send the student home at the student’s own expense. MindfulTraveller makes every effort to ensure the accuracy of its publica­tions, but it is not responsible for typographical, printing or website content errors, including, but not limited to pricing information. Payment of the required fee/deposit constitutes consent to all provisions of these Enrollment Conditions and to the general information contained herein this website. No warranties, representations, or waiver of these Enrollment Conditions apply to any program unless expressly stated within these Enrollment Conditions (or in writing signed by an officer of Mindfultraveller).

Reference to “trip and retreat member” or “member” shall refer to any person who is attending the trip or retreat and has a confirmed booking.

References to  us ,  we , and/or  our  in these booking terms and conditions shall mean MindfulTraveller.com represented through travelmania Ltd. Where bookings of travel products are made on your behalf via MindfulTraveller, references to  us ,  we , and/or  our  in these booking terms and conditions shall also mean and include Travelmania Ltd trading as MindfulTraveller.

By proceeding with your booking, you acknowledge you are 25 years of age or older and that you understand and agree with the above terms and conditions.
